1. Introduction
These Terms of Service ("Terms") govern your access to and use of AxixOS ("we", "us", "our"), a governed multi-channel content publishing platform, together with any related websites, APIs, and services (collectively, the "Service").
This document is provided for transparency and does not constitute legal advice.
2. Acceptance of terms
By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you are using the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms. If you do not agree, you must not use the Service.
3. Description of the service
AxixOS lets you connect social media and content accounts and create, schedule, publish, and analyse content across those channels, with built-in governance and workflow controls. Features may be added, changed, or removed over time.
4. Eligibility
You must be at least 16 years old (or the age of digital consent in your jurisdiction) and capable of forming a binding contract to use the Service. You are responsible for ensuring your use complies with all laws that apply to you.
5. Accounts and registration
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. Notify us promptly of any unauthorised use. We may suspend or terminate accounts that are inactive, compromised, or used in breach of these Terms.
6. Connected social accounts
When you connect a third-party account (for example Facebook, Instagram, LinkedIn, X, YouTube, TikTok, or Google Business Profile), you authorise AxixOS to access and act on that account on your behalf to the extent of the permissions you grant — for example, to publish content or retrieve analytics.
You represent that you have the right to connect each account and to publish the content you submit through it. You may disconnect an account at any time from the Channels page, which revokes or removes the associated access tokens.
7. Acceptable use
You agree not to use the Service to:
- Publish content that is unlawful, infringing, defamatory, harassing, hateful, or otherwise objectionable.
- Violate the terms, policies, or rate limits of any connected third-party platform.
- Distribute spam, malware, or engage in deceptive or fraudulent activity.
- Attempt to gain unauthorised access to the Service, other accounts, or our systems.
- Interfere with or disrupt the integrity or performance of the Service.
8. Your content
You retain ownership of the content you create, upload, or publish through the Service ("Your Content"). You grant us a limited licence to host, process, and transmit Your Content solely to operate the Service and to perform the publishing and analytics actions you request.
You are solely responsible for Your Content and for ensuring you hold the necessary rights and permissions to publish it on each connected platform.
9. Third-party platforms and APIs
The Service integrates with third-party platforms through their APIs. Your use of those platforms is governed by their own terms and policies. We are not responsible for the availability, behaviour, or data-handling practices of third-party platforms, and they may change or restrict their APIs at any time in ways that affect the Service.
10. API and automated access
We may provide API keys that allow external tools to submit content to the Service on your behalf. You are responsible for keeping API keys secret and for all activity performed with them. We may revoke keys, or rate-limit or suspend access, to protect the Service or to comply with third-party platform requirements.
11. Intellectual property
The Service, including its software, design, and branding, is owned by AxixOS and protected by intellectual property laws. Except for the rights expressly granted to you, these Terms do not transfer any rights in the Service to you. You may not copy, modify, reverse engineer, or create derivative works from the Service except as permitted by law.
12. Fees and payment
Some features may require payment. Where fees apply, they will be described at the point of purchase. Unless stated otherwise, fees are non-refundable. We may change pricing on a prospective basis with reasonable notice.
13. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content will be published successfully to any third-party platform.
14. Limitation of liability
To the maximum extent permitted by law, AxixOS will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim will not exceed the amount you paid us for the Service in the twelve months preceding the claim.
15. Indemnification
You agree to indemnify and hold harmless AxixOS from any claims, damages, liabilities, and expenses arising out of Your Content, your use of the Service, or your breach of these Terms or of any third-party platform's terms.
16. Suspension and termination
You may stop using the Service at any time. We may suspend or terminate your access if you breach these Terms, if required to protect the Service or other users, or to comply with law or third-party platform requirements. Provisions that by their nature should survive termination will survive.
17. Changes to the service
We may modify, suspend, or discontinue any part of the Service at any time. Where a change materially reduces core functionality, we will make reasonable efforts to provide notice.
18. Changes to these terms
We may update these Terms from time to time. When we make material changes, we will update the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
19. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws principles. The courts of England and Wales will have exclusive jurisdiction over any dispute, unless mandatory local law provides otherwise.
